Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Alfa Personal Finance mobile application (the "App"). The App is operated by Bryan Tan Hou Quan, an individual based in Malaysia ("Alfa", "we", "us" or "our"). You can contact us at any time at privacy@alfapersonalfinance.com. By creating an account, you agree to be bound by these Terms and by our Privacy Notice.

1. Description of service

Alfa Personal Finance is a personal budgeting and finance tracking application. It allows you to record income, expenses and savings, set budgets, track accounts, and view financial summaries. The App is a record-keeping tool. Nothing in the App constitutes financial, investment, tax or legal advice.

The App is intended for users aged 18 years and above. By using the App you represent that you have the legal capacity to enter into these Terms in your jurisdiction.

To use the App you must create an account using a valid email address or sign in with a third-party provider supported by us (such as Google). You are responsible for:

We grant you a personal, non-transferable, non-exclusive, revocable licence to install and use the App for your own personal, non-commercial use, subject to these Terms.

5. Fees and payment

The App is currently free to use. If we introduce paid features, subscriptions or in-app purchases in the future, we will tell you the price and the applicable terms before you are charged. Any payment will be processed by the relevant app store (Apple App Store or Google Play) under its own billing and refund rules. You will never be charged for a paid feature without your clear prior agreement.

You retain ownership of the financial records, categories and other data you enter into the App ("Your Content"). You grant us a limited licence to host, store, process and display Your Content for the purpose of operating the App, in accordance with our Privacy Notice.

8. Our intellectual property

The App, including its name, logo, design, text, graphics and software, is owned by us or our licensors and is protected by intellectual property laws. Except for Your Content, nothing in these Terms transfers any intellectual property rights to you. You may not copy, modify, distribute or create derivative works from any part of the App, except as expressly permitted by these Terms or by law.

The App is provided for informational and record-keeping purposes only. We do not provide, and nothing in the App should be construed as, financial, investment, tax or legal advice. You are solely responsible for your financial decisions. Consult qualified professionals where appropriate.

10. Third-party services

The App relies on third-party services including Google Firebase (Cloud Firestore, Firebase Authentication) and, where you choose, Google Sign-In and Sign in with Apple. Your use of those services is also subject to their respective terms.

11. App store terms

If you download the App from the Apple App Store or Google Play, you also agree to the applicable store's terms. You acknowledge that these Terms are between you and us only, and not with Apple or Google, and that Apple and Google are not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a relevant trade embargo and that you are not on any government list of prohibited or restricted parties.

12. Termination

We may suspend or terminate your access to the App at any time if you breach these Terms or applicable law, or if continued provision of the App becomes commercially or legally unviable. You may terminate your account at any time via Settings → Delete account.

13. Limitation of liability

To the fullest extent permitted by Malaysian law, in no event shall we, our directors, employees or agents be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the App. The App is provided "as is" and "as available" without warranties of any kind.

14. Indemnity

You agree to indemnify and hold us harmless from any claim, demand or damages arising out of your breach of these Terms or your violation of any law or the rights of a third party.

15. Force majeure

We are not liable for any failure or delay in providing the App caused by events beyond our reasonable control, including network or hosting outages, acts of government, natural disasters or failures of third-party services.

16. Changes to these Terms

We may amend these Terms from time to time. Material changes will be notified through the App. Continued use of the App after a change constitutes your acceptance of the amended Terms.

17. Governing law and jurisdiction

These Terms are governed by the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

18. Severability, waiver and assignment

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not transfer or assign your rights under these Terms without our consent. We may assign our rights and obligations under these Terms to another party, for example as part of a sale or reorganisation of the business.

19. Entire agreement

These Terms, together with our Privacy Notice, form the entire agreement between you and us regarding your use of the App and replace any prior agreements or understandings.
